Disney did not get all of Marvel’s licensing rights in their contract when they purchased Marvel Entertainment in 2009. Disney is limited how they can use Marvel and which characters they can use in their parks. Prior to Disney’s purchase of the wildy popular company, Marvel signed an agreement with MCA Inc. who owned the Universal Studios theme parks. This is why there is a Marvel Superhero Island in Island’s of Adventure where you can ride The Hulk, The Amazing Adventures of Spider-Man, Storm Force Accelatron and Doctor Dooms Fearfall.

According to Disney’s Marvel contract, any characters that are in use down the street at Universal Studios Orlando, cannot be used by Disney in their parks east of the Mississippi River. Universal owns the rights “in perpetuity” meaning as long as the the contract is in good standing, Universal will have those rights.

To confirm, these are the Marvel attractions you can find at both Florida parks:

Which Marvel Rides are in Universal Orlando?

  • The Incredible Hulk Coaster
  • The Amazing Adventures of Spider-Man
  • Doctor Dooms Fearfall
  • Storm Force Accelatron

  • Guardians of the Galaxy: Cosmic Rewind

As long as Universal continues to pay Disney, there will be no Avengers Campus in Disney World due to the Mississippi River clause in their contract. This combined with the fact that they have limited rights to some characters, is why there is no avenger campus Disney World. Since California is west of the Mississippi River, Disneyland guests have been enjoying exploring the Avengers compound and meeting beloved superheros like Captain America and Thor.

To confirm, the Walt Disney Company owns Marvel Entertainment as of 2009. However, in 1994, Universal’s then-parent company signed a contract with Marvel that gave them the rights to use Marvel in the Universal parks. Although Disney does own Marvel, there is no Marvel in Disney World once again, because of this contract between Universal and Marvel.

Which Marvel Characters Can Disney Use?

Universal can use the properties from The Avengers, X-Men, Spider-Man, and Fantastic Four. Disney cannot install attraction from any of these families for use in Orlando. This means no Iron Man, Spider Man, or Doctor Doom in Orlando, but these popular characters are fair use in other Disney Parks. Disneyland Paris just debuted their new Iron Man attraction in anticipation for the opening of Avengers Campus Paris.

Possible characters that we may see in Orlando include

  • Guardians of the Galaxy
  • Doctor Strange

Since they do not have direct ties to The Avengers or Fantastic Four in the Marvel Comics.

Is Spiderman at Disney World

Spiderman is not at Disney World and has no plans to be in Orlando due to the contract with Universal. This contract is in perpetuity which means that unless for some reason the contract becomes void due to poor upkeep, not upholding the quality of the intellectual property or Universal chooses to terminate it, then there will be no Spiderman at Disney World.
